Terms of Service

Welcome to Hibern. These Terms of Service ("Terms") govern your access to and use of the Hibern mobile application ("App") provided by Hibern ("we," "our," or "us"). By downloading, installing, or using Hibern, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By creating an account or using Hibern, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Hibern is a mission-based alarm application designed to help users wake up by requiring the completion of a verification task ("Mission") before the alarm can be dismissed. The App provides:

  • Customizable alarms with scheduled notifications
  • Wake-up missions including QR scanning, photo proof, physical activity, and cognitive challenges
  • Streak tracking and progress statistics
  • Customizable alarm card designs
  • Premium features through an optional subscription (Hibern Plus)

3. Account Registration

Some features of Hibern may require you to create an account. You agree to provide accurate and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Alarm Functionality Disclaimer

Hibern is designed to encourage consistent wake-up habits, but we cannot guarantee that the alarm will ring in all circumstances. Due to iOS system limitations on third-party applications:

  • Alarms rely on local notifications, which may be affected by device settings, Do Not Disturb mode, or low battery
  • The App cannot override system-level controls or prevent the user from force-closing the application
  • We do not claim that the alarm is impossible to turn off or impossible to bypass

Hibern should not be relied upon as a sole alarm for critical or safety-sensitive wake-up situations. We recommend using Hibern alongside your device's built-in alarm for important events.

5. Hibern Plus Subscription

Subscription Plans

Hibern offers an optional premium subscription ("Hibern Plus") that provides access to advanced features including unlimited alarms, advanced missions, premium card styles, detailed statistics, and more. Subscription details and pricing are displayed in the App.

Billing

Hibern Plus subscriptions are billed through Apple's App Store. All payments are processed by Apple and are subject to Apple's Terms and Conditions. We do not directly handle payment information.

Free Trials

We may offer free trial periods for Hibern Plus. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription at the displayed price.

Cancellation & Refunds

You can cancel your Hibern Plus subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. Refund requests must be directed to Apple, as they handle all billing. We do not process refunds directly.

6. Acceptable Use

You agree to use Hibern only for its intended purpose and in compliance with applicable laws. You agree not to:

  • Reverse-engineer, decompile, or disassemble any part of the App
  • Attempt to circumvent security features, subscription restrictions, or mission verification systems
  • Use the App to collect, store, or share personal information of others without their consent
  • Use the App in any way that could harm, disable, or impair the service
  • Upload or transmit malicious code, viruses, or harmful content
  • Misrepresent your identity or impersonate any person or entity

7. Intellectual Property

All content, features, and functionality of Hibern — including but not limited to the App design, code, graphics, polar bear brand mark, alarm sounds, mission designs, and text — are owned by Hibern and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. User Content

Certain missions may involve you taking photos or creating content ("User Content"). You retain ownership of your User Content. By using these features, you acknowledge that photos taken for missions are processed locally on your device and are not submitted to our servers unless otherwise stated.

9. Health & Safety

Some missions involve physical activities such as squats, push-ups, or walking. By using these missions, you acknowledge that:

  • You participate in physical missions at your own risk
  • You should consult a healthcare professional before engaging in physical exercise if you have any health concerns
  • Hibern does not provide medical or fitness advice
  • You are responsible for exercising in a safe environment

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Hibern is provided "as is" and "as available" without warranties of any kind, express or implied
  • We do not warrant that the App will be uninterrupted, error-free, or free of harmful components
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
  • Our total liability for any claims arising from the use of Hibern shall not exceed the amount you paid for Hibern Plus in the 12 months preceding the claim

11. Indemnification

You agree to indemnify, defend, and hold harmless Hibern and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or your violation of these Terms.

12. Termination

We may terminate or suspend your access to Hibern at any time, with or without cause, with or without notice. Upon termination, your license to use the App is revoked. You may stop using Hibern and delete the App at any time.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or by updating the "Last updated" date. Your continued use of Hibern after changes are posted constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of France.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
